These Terms of Service ("Terms") govern your access to and use of the SYSTEM DRVN OS platform, including the Franchise Market Audit tool, Command Center, and all associated services (collectively, the "Service") operated by SYSTEM DRVN OS ("we," "us," or "our") at systemdrvn.com.

Access to the Command Center and administrative features is restricted to authorised personnel only. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. 2. Description of Service

SYSTEM DRVN OS provides an AI-powered franchise market intelligence and lead management platform. The Service includes, but is not limited to:

• The Franchise Market Audit — an AI-graded assessment tool that evaluates franchise readiness
• Automated report generation and PDF delivery via email
• Lead capture, scoring, and CRM-style management
• AI-powered outreach and follow-up automation via Twin.so
• Expo intelligence and account management tools

The AI-generated grades, scores, and recommendations are provided for informational purposes only and do not constitute financial, legal, or investment advice.

3. Data Collection and Use

When you complete the Franchise Market Audit, we collect the information you provide, including your name, email address, phone number, company name, and survey responses. This information is used to:

• Generate your personalised AI market analysis report
• Send you your audit results and supporting materials via email

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Service without our express written consent.

6. Security and Confidentiality

We implement industry-standard security controls aligned with SOC 2 Type II principles, including but not limited to:

• Encryption of data in transit via TLS 1.2+
• HTTP Strict Transport Security (HSTS) with preload
• Content Security Policy (CSP) headers
• Rate limiting on all public-facing endpoints

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AI-generated scores, grades, and recommendations are probabilistic outputs and should not be relied upon as definitive assessments of franchise viability or investment suitability.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SYSTEM DRVN OS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Miami, Florida, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

We will provide notice of material changes by updating the effective date at the top of this page and, where appropriate, by sending an email to the address associated with your account.
